Chuhak & Tecson hosts webinar on association dues and lease payment collections during the COVID-19 pandemic
Chuhak & Tecson, P.C. will host a webinar, titled “Collecting lease payments and association dues in a time of crisis,” from 10 to 11:30 a.m. Thursday, May 28. Kevin Coyne, principal and leader of the firm’s Real Estate practice, will serve as the moderator and scheduled panelists include DuPage County Associate Judge James McCluskey, Chuhak & Tecson principal James Stevens and associate Adam Beattie. The panelists will engage in a practical discussion, reviewing litigation strategies, negotiation tips, impacts to eviction processes and other legal considerations in light of the current health crisis. McCluskey has been a licensed attorney for over 40 years and, in 2018, was appointed as an associate judge in the DuPage County Court’s Chancery Division, where he presides over eviction cases among other matters. Prior to his judgeship, he was the founder and partner of Momkus McCluskey LLC, a general practice law firm based in Lisle, Illinois. McCluskey focused his practice in real estate, commercial, shareholder’s disputes and probate litigation and has tried over 60 jury trials to verdict in state and federal courts. He was appointed by the Illinois Supreme Court to its Committee on Professional Responsibility, and he also served as a past president of both the Illinois State Bar Association and the DuPage County Bar Association.
Coyne represents national franchises, restaurants, bars and professional practices and has substantial experience negotiating office, retail and industrial leases on the national and local levels for landlords and tenants. He relishes his roles as both legal counsel and business advisor for commercial property transactions, and he is rapidly expanding his knowledge relative to COVID-19 and commercial lease obligations, writing on considerations in which landlords and tenants should take note. Safe DuPage, an initiative that is assisting DuPage County residents affected by the ongoing health crisis and regularly participates in webinars which discuss commercial lease obligations in light of the pandemic. Stevens represents condominium and homeowner’s association clients in a wide range of both litigation and transactional matters. Among other concerns, he manages easement drafting, bylaws, declarations, developer turnover matters, enforcement litigation, collection of assessments and interpretation of governing documents. He also defends boards of directors in courtroom proceedings and advises clients on the Illinois Condominium Property Act, Forcible Entry and Detainer, Illinois Business Corporation Act, Not for Profit Corporation Act and Common Interest Community Association Act.
Beattie focuses his practice on litigation and condominium and common interest community association law. His litigation experience includes breach of contract, trademark disputes, internal business disputes, landlord and tenant litigation (RLTO), commercial evictions, products liability defense and trust and trustee litigation. Beattie has also worked with other attorneys in the firm litigating collection matters, enforcing the declaration and rules of homeowners’ associations and providing counsel and advice to board members in the exercise of their duties and obligations to the association.
