Affiliation agreements

The firm has worked with numerous health care entities to create affiliation agreements. These agreements cover a wide array of relationships such as the provision of hospice services in hospitals and long-term care facilities; provision of resident services by academic medical centers at community hospitals; creation of new entities which are jointly owned by existing healthcare entities; an agreement by a stand along facility to become part of a larger healthcare system.

The firm addresses governance issues relative to reserve powers and decisions needing super majority consent as well as regulatory issues under the Medicare and Stark laws relative to referral of patients to joint venture entities.
