How can you avoid the courts?

Unless you’re a lawyer who frequents courtrooms, it’s generally a good idea to avoid court appearances. Sure, obeying the law and following speed limits is a good start, but what else can you do to sidestep unnecessary court appearances? This week, we’re focusing on practical estate planning measures that can help you steer clear of judicial proceedings:

Power of Attorney. Imagine a scenario where you’re alive, but incapable of making health or financial decisions. Guardianship, a court-supervised method of handling these decisions, can be both costly and invasive. With a Power of Attorney, you can designate a trusted individual — like a spouse or an adult child — to make these critical decisions for you, eliminating the need for a judge’s intervention.

Living Trusts. A common misconception is that having a will means your heirs won’t have to face court proceedings. In reality, all wills require probate. If your goal is to sidestep probate — a preference for many — you need more than just a basic will. A living trust is one of the most popular tools used by people of all economic classes. Another common misconception is that trusts are “just for the rich.” By creating and correctly funding a living trust, you can save your loved ones from unnecessary hassles and expenses after your passing.
