Daniel J. Fumagalli

Of Counsel

Striking the perfect balance between a determined advocate and a thoughtful counselor, Dan Fumagalli works with individuals and businesses to protect their interests and achieve positive outcomes in a wide range of disputes.

Overview

Dan’s decades of experience across a broad spectrum of matters, from business disputes to employment claims to trademark and trade secret claims, have instilled in him a recognition of how protracted litigation, while sometimes unavoidable or necessary, is a blunt instrument that is rarely the preferred way to achieve a desired outcome. While he will not hesitate to go to the mat to protect or advance his clients’ interests in trial or appellate courtrooms, his diplomatic inclinations make Dan equally adept at reaching favorable resolutions that spare his clients from the risks, costs and disruptions inherent in most lawsuits.

Approaching every case with clear-eyed realism and rational analysis, Dan is honest and pragmatic in his counsel, telling his clients what they need to hear about the legal, financial and practical realities of their case and their prospects for success. Dan’s clients know that he will always try to use his creativity and advocacy to find a path that gets them where they want to go based on realistic expectations.

Dan’s practice spans a wide range of disputes that business owners regularly face. A member of Chuhak & Tecson’s Employment practice group, Dan deftly handles employment claims that raise serious legal and reputational risks for businesses, protecting their interests in workplace discrimination lawsuits, matters involving restrictive covenants and trade secrets, overtime and minimum wage issues under the FLSA and claims before the EEOC and other regulatory bodies. Dan also provides proactive guidance on workplace policies and procedures, as well as drafting and reviewing employee handbooks, empowering his clients with the tools they need to minimize the likelihood of future claims. He regularly shares his employment law insights at firm-sponsored seminars and presentations regarding employment law issues, including race and age discrimination.

In addition to employment issues, Dan represents his clients in a wide range of other litigation matters, including shareholder disputes, trade secrets claims, copyright and trademark infringement lawsuits, business contract disputes, injunctions and other chancery actions. He also has handled a variety of contested estate and trust litigation matters.

Dan’s effective representation extends to the appellate level, where he has appeared before the U.S. Courts of Appeals for the Seventh and Federal Circuits, as well as Illinois appellate courts and the Illinois Supreme Court.

Passionate about serving others, Dan received the Award for Excellence in Pro Bono Service from the U.S. District Court for the Northern District of Illinois and the Chicago Chapter of the Federal Bar Association for his pro bono work pursuing a race discrimination claim on behalf of an indigent client.
